Terms of Service
Fox Pay is operated by TG11 LLC, doing business as Fox Pay ("we", "us"). These terms cover both people paying through a Fox Pay checkout and merchants using the API. Using either means you accept them.
1. What Fox Pay is, in legal terms
Fox Pay is a technical service that routes a payment to a payment provider. It is not a bank, a money transmitter, an acquirer, a custodian or the seller of anything you buy. The merchant is the seller and the merchant of record; the provider (Stripe, PayPal, Square or the crypto network) moves the money.
2. If you are paying for something
- Your contract for the goods or services is with the merchant, not with us. Delivery, quality, cancellations and refunds are theirs to answer for.
- Refunds start with the merchant. We can only return money the merchant instructs us to return, through the provider that took it.
- Card details are entered with the provider, not with us. We never see or store a card number.
- The amount shown at checkout is what is authorised. Your bank or wallet may apply its own fees or currency conversion.
- An authorisation is not a payment: it places a hold that is either captured or released. A crypto invoice settles when the network confirms it, and an underpaid or expired invoice may need the merchant's help to resolve.
- Disputes and chargebacks go through your card issuer or wallet provider, and we cooperate with whatever they require.
3. If you are a merchant
- You are responsible for what you sell, for your own terms and refunds, for your tax position, and for the accuracy of the amounts you send us.
- Keep your API keys and webhook secrets secret. Anything done with your key is treated as done by you; rotate a key the moment you suspect it leaked.
- Do not send us cardholder data. The API takes amounts and references, and any request that appears to carry card details will be rejected.
- You must follow the acceptable use guidelines and the rules of whichever provider you route through. Their prohibited-business rules apply to you as much as ours do.
- Settlement, fees and payout timing are set by your provider account, not by Fox Pay.
- We may suspend routing for an account that puts the service, a provider relationship or other users at risk.
4. Accounts
A Fox Pay account signs in through TG11 Accounts. Keep your credentials safe and turn on two-factor authentication there; changing a saved payment method asks you to prove it is still you.
5. Availability
Fox Pay is provided "as is" and "as available", and it is early software. Features can change or be withdrawn, and a provider outage can stop payments through that route. Current state is on the status page, and notable changes are listed in the changelog.
6. Liability
To the fullest extent the law allows, TG11 LLC is not liable for indirect, incidental, special, consequential or punitive damages, nor for a merchant's conduct or a provider's outage. Our total liability for a claim is limited to the Fox Pay fees you paid us for the transaction the claim concerns.
Nothing here limits a right you have as a consumer that cannot be waived, including your right to dispute a charge with your bank.
7. Changes
We may update these terms; the version and date at the top change when we do, and continuing to use Fox Pay afterwards means the new terms apply.
8. Governing law
These terms are governed by the law of the operator's primary jurisdiction in the United States, except where non-waivable local consumer law says otherwise.
